TEMPORARY ORDERS

GENERAL INFORMATION

A temporary order is an order that lasts for a certain amount of time or until a certain event happens.  Usually a temporary order lasts until the Decree of Divorce is finalized. 

Either party can request a temporary order from a judge by filing a motion. A motion is a document that asks the court for specific relief and tells the court the facts of the case and what law applies. 

Once a Motion is filed and served, the opposing party has ten days to respond by filing an opposition. An opposition is a document that tells the judge what parts of a motion the party agrees with and what parts of a motion the party does not agree with.

When a motion is filed with Master Calendar the Clerk will assign the motion a court hearing date and time.  At the court hearing the judge will make a ruling on the motion.  The judge's ruling is called a court order.  Usually, the judge's order is not enforceable until it is in writing, signed by the judge, and filed with the Clerk of the Court.

Local rules give the prevailing party ten days to prepare the order from the date of the hearing.  Orders should be prepared using the court minutes which can be obtained from the Records Department of the Clerk's office free of charge. Below are the Self-Help Center's court order form packets

To choose a packet please read the brief description of each packet.  If you are still unsure of which packet to use, open each packet and read at least the first two pages of the instructions. You may use a packet if all of the statements under the heading "Explanation" apply to your particular situation.  If all of the statements do not apply to your particular situation then that packet is not the correct packet.
