CHANGE OR ENFORCE A COURT ORDER

GENERAL INFORMATION

You can use the packets below to change or enforce an existing valid court order.  A court order is not valid unless it is signed by a family court judge and filed with the Clerk of the Court.

Motions and Oppositions

Either party can request to change or enforce a court order by filing a motion.  A motion is a document that asks the court for specific relief and tells the court the facts of your case and what law applies.

Once a motion is filed and served, the opposing party has ten days to respond by filing an opposition. An opposition is a document that is filed in response to a motion.  It tells the judge what parts of the motion the party agrees with and what parts of the motion the party does not agree with.

Grounds for Modification of Child Support and Custody

Under Nevada law, parents have the right to request a change of child support every three years and whenever there has been a substantial change in circumstances. On the other hand, a judge may only change an order for primary physical custody when there has been a substantial change in circumstances affecting the child and when it is in the best interest of the child. Likewise, a judge may only change an order for joint physical custody when it is in the bests interest of the child.

Stipulations and Orders

When both parties in a case wish to enter into an agreement and make that agreement a binding court order they can submit a Stipulation to their judge. If the judge approves the agreement the judge will sign an Order that makes the agreement binding. Usually, judges will approve stipulations by the parties as long as the stipulation is not illegal or against public policy.

To choose a packet please read the brief description of each packet.  If you are still unsure of which packet to use, open each packet and read at least the first two pages of the instructions. You may use a packet if all of the statements under the heading "Explanation" apply to your particular situation.  If all of the statements do not apply to your particular situation then that packet is not the correct packet.
