INSTRUCTIONS/PROCEDURES:
Motions
All motions take between ½ day to one whole day to process. Firms need to send their runner to the Discovery runner pick-up (on the 5 th floor of the Regional Justice Center) to pick up their motion. If the motion has been provided with a calendar date and time it then needs to be filed at Master Calendar in the clerk’s office. Our office does not give any calendar dates over the phone. Also, we do not contact the firms when the motion is ready for pick up.
If you need to know when something is on calendar, make sure you check Blackstone first, all motions set before the Discovery Commissioner can be seen on Blackstone.
If you receive or are served with a blank motion that does not contain a hearing date or time or a file stamp, please contact the attorney or firm who served the motion on you. Receiving an unfiled motion does not constitute proper service.
Stipulation & Orders
Stipulation & Orders can take up to a week to be processed. Once the Discovery Commissioner signs the submitted Stipulation & Order our office will return the documents back to the firm. The documents will either be placed in the firm’s folder in the clerk’s office or will be placed in the Discovery Commissioner’s runner pick-up if the document was submitted with an attached runner service, run slip. If the document is returned, signed by the Discovery Commissioner, the firm must then file the document with the clerk’s office.
Discovery Commissioner’s Report & Recommendations
The Discovery Commissioner’s office will process the Report & Recommendations. The entire process usually takes about three weeks from the time that the firm delivers the Report and Recommendations to the Discovery Commissioner’s office. Once the Discovery Commissioner signs the Report & Recommendations, we then serve all parties with a courtesy copy of the signed Report & Recommendation. All parties have eight full judicial days to object to the Report & Recommendations from the date of service (see notice page on Report & Recommendation). Any objections to the Report & Recommendations must be filed with the clerk’s office, then a file stamped courtesy copy must be delivered to the Discovery Commissioner’s office. When the objection time expires, Discovery will forward the original Report & Recommendations and any timely objections to the judge. Once the judge signs the Report & Recommendations, Discovery will pick the original signed order up from the judge, file the Report & Recommendations in the clerk’s office then serve a copy to all listed parties.
* When you receive an unfiled copy of the Report and Recommendation, signed by the Discovery Commissioner, do not forward this to the judge. This is your courtesy copy letting you know that the time to object has begun.
